1. Agreement to Terms

By accessing and using CarBazaar, you accept and agree to be bound by the terms and provision of this agreement. These Terms & Conditions apply to all users of the site, including browsers, vendors, customers, merchants, and/or contributors of content.

2. Use License

Permission is granted to temporarily use CarBazaar for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials

3. User Accounts and Listings

Account Registration

Users must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

Vehicle Listings

When listing a vehicle, you agree to:

• Provide accurate and truthful information about the vehicle including year, make, model, mileage, and condition
• Upload genuine photos of the actual vehicle being sold (no stock photos or photos of similar vehicles)
• Set a fair and reasonable asking price based on market conditions
• Respond promptly to genuine buyer inquiries within 48 hours
• Not post duplicate listings for the same vehicle across multiple accounts
• Remove the listing promptly once the vehicle is sold or no longer available
• Only list vehicles that you own or have explicit authorization to sell
• Include all known defects, damage, or issues with the vehicle

Content Review and Moderation

All listings and user-generated content are subject to review by CarBazaar. We reserve the right to:

• Review and moderate all listings before they go live
• Remove or modify content that violates our policies
• Request additional verification or documentation for listings
• Flag suspicious or potentially fraudulent listings for investigation

4. Prohibited Activities

Users are prohibited from:

• Posting false, misleading, or fraudulent listings or information
• Using stolen, stock, or misleading photos that don't represent the actual vehicle
• Listing vehicles that are not legally owned or authorized for sale
• Price manipulation or artificially inflating vehicle values
• Using the platform for any illegal activities or transactions
• Harassing, threatening, or abusing other users
• Posting spam, irrelevant content, or non-automotive related listings
• Attempting to circumvent platform policies or fees
• Creating multiple accounts to evade restrictions or manipulate listings
• Scraping or extracting user data without authorization
• Posting content that infringes intellectual property rights
• Engaging in discriminatory practices based on protected characteristics

5. Enforcement and Account Actions

CarBazaar reserves the right to take the following actions for policy violations:

• Warning: First-time minor violations may receive a warning
• Listing Removal: Individual listings that violate policies will be removed
• Account Restriction: Temporary limitations on posting new listings or account features
• Account Suspension: Temporary suspension of account access for serious or repeated violations
• Account Termination: Permanent ban for severe violations, fraud, or continued policy violations
• Legal Action: Referral to law enforcement for illegal activities

The severity of enforcement action depends on the nature and frequency of violations. Users will be notified of enforcement actions via email when possible. Repeated violations will result in escalated enforcement measures.

6. Content and Intellectual Property

Users retain ownership of content they post but grant CarBazaar a non-exclusive, worldwide license to use, display, reproduce, and distribute such content on the platform for operational purposes. CarBazaar reserves the right to:

• Remove any content that violates these terms or applicable laws
• Use aggregated, anonymized data for analytics and improvement purposes
• Display user content in search results, featured listings, and promotional materials
• Modify the presentation of content for different devices and formats

Users must ensure they have the right to post all content and that it doesn't infringe on third-party intellectual property rights.

7. Privacy and Data Protection

CarBazaar respects user privacy and handles personal data in accordance with our Privacy Policy and applicable data protection laws. Key points include:

• Contact information is shared between buyers and sellers to facilitate transactions based on user preferences
• Users can control their contact visibility settings in their profile
• Personal data is protected with appropriate security measures
• Users have rights to access, modify, and delete their personal information
• We do not sell personal information to third parties

8. Transactions and Payments

CarBazaar facilitates connections between buyers and sellers but is not a party to any transaction. All negotiations, payments, and transfers are between the buyer and seller directly. CarBazaar is not responsible for:

• The quality, safety, or legality of vehicles listed
• The accuracy of listings or user representations
• Payment disputes between parties
• Vehicle condition or title issues

9. Disclaimers

The materials on CarBazaar are provided on an 'as is' basis. CarBazaar makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights.

10. Limitations of Liability

In no event shall CarBazaar or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use CarBazaar, even if CarBazaar or its authorized representative has been notified orally or in writing of the possibility of such damage.

11. Termination

CarBazaar may terminate or suspend access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms & Conditions.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Ireland and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

13. Changes to Terms

CarBazaar reserves the right to revise these terms of service at any time without notice. By using this web site you are agreeing to be bound by the then current version of these terms of service.
